2. For the purposes of section 1.2 of the Act respecting legal aid and the provision of certain other legal services (chapter A-14), a person other than the father or mother or one of the parents who may compose a family with children is the person who has custody of the children under a judgment of the court, except in the case of a foster family within the meaning of the Act respecting health services and social services (chapter S-4.2) or of the Act respecting health services and social services for Cree Native persons (chapter S-5).

2.
